OFC. BURGER'S PERJURY--Exhibit 9 (A)
Palo Alto Police Officer Kelly Burger Testified under Penalty of Perjury that he drew his taser gun TWO separate times from his holster and that his taser gun was in his holster while he pulled Ciampi from the vehicle and up against a fence.
The Audio/Video footage from Burger's own taser video contradicts his statement exposing him as committing perjury in an attempt to explain why there is missing video footage from his taser gun.
Officer Manuel Temores' MAV Microphone Exhibit-- 9(B)
Officer Temores' MAV recording did not have any audio. Police Chief Lynne Johnson stated in an email to the public that the reason by Temoes' MAV recording was missing audio was due to a malfunction.
However Ofc. Manuel Temores whose MAV video Johnson is referring to testified that the microphone did not malfunction but that the battery that powers the microphone ran out of power contradicting Chief Johnson.
There is just ONE MAJOR PROBLEM with Temores' explanation. A fully charged battery can power a microphone for ten, (10) continuous hours. Temores came on duty at 5:00 am and the incident began at 10:00 am, FIVE hours later. If the battery was fully charged is should have powered the microphone for the entire incident. Even if the battery was not fully charged, Temores stated that the microphone was working, recording, at 5:00 am in the morning, thus even if the battery was not fully charged it should have at least recorded the first few minutes of the incident at 10:00 am if the battery had as little as a 5% charge.
Temores' and Chief Burns, who was attending the court proceeding in which Temores testified to the above, reveal their bogus explanation when Temores states that, "IT IS COMMON FOR THE MICROPHONES TO RUN OUT OF POWER."

According to Police Chief Dennis Burns it is common for a very expensive recording device to not accomplish on a regular basis what the City of Palo Alto and the Palo Alto Police, purchased it for.
However Burns is contradicted by the specifications of the MAV system which he and the City of Palo Alto purchased.

Officer April Wagner's bicycle Helmet Exhibit-- 9(C)
Palo Alto Police Officer April Wagner asserted in her police report and Declarations that her bicycle helmet broke during the March 15, 2008 incident.
This is supported by photographs taken of her bicycle helmet at Stanford Hospital approximately an hour after the incident.
However Wagner's helmet was photographed undamaged 15 minutes after she claimed it had been damaged and 30 to 45 prior to the photographs taken at the hospital. In this photograph the helmet is not damaged.
Conclusion: Wagner and her superior, Chief Dennis Burns, refused to secure her helmet into evidence because the helmet was not damaged. Wagner removed the visor from the helmet to falsely make it appear that it had been damaged when in fact it had not.

Chief Burns stated that Ciampi displayed signs of being under the influence of drugs in his report to the Palo Alto City Council:
The Palo Alto Police Department's Own Toxicology Report from the March 15, 2008 Incident Verifies that Ciampi WAS NOT Under the Influence of Any drug or Alcohol.
Ciampi's medical records verify that Ciampi's skin condition is the result of health problems and that Ciampi is NOT a drug user.

ACCORDING TO PALO ALTO POLICE CHIEF DENNIS BURNS AND HIS SUBORDINATE OFFICERS THE NATURAL HUMAN EMOTION OF ANGER IS THE RESULT OF DRUG USE.

Former Palo Alto Policy Chief Lynne Johnson defended one her own off duty officer who went into a profanity laced tirade for being pulled over for a traffic violation claiming that her officer was justified in being angry because the on duty officer provoked the Palo Alto Police Officer. Based upon Chief Johnson’s remarks she does not believe that anger is symptomatic of being on drugs otherwise she would not have defended her own officer's actions.

Watching Woman False--EXHIBIT 9(E)
Palo Alto Police Chief Falsely States that the Reporting Parting Stated that Ciampi was Leering at the Reporting Party's Wife and Young Children.
One: Reporting Party Never Makes the above allegation to the officers on scene as documented in the police report.
Two: The Reporting Party Never Makes the above allegation to the dispatcher as documented in the Call for Service Transcript.
Three: The Reporting Party actually states that he is the only one home, and that his wife is away on vacation and his daughter is away at school, (college prep).
Four: The Radio Dispatcher Never Makes the above allegation to the officers as documented in the Radio Dispatch Transcript.
CONCLUSION: Police Chief Dennis Burns and his subordinate officers are the only ones to make the false statement in their official reports. Why would they make this false statement and lie to the community about a fellow citizen in this manner?
