Former Palo Alto Police Officer Manuel Temores and his fellow officers unlawfully detained and arrested a citizen and then used excessive force in using two taser guns simultaneously along with other force. Please keep in mind that as the lies of Ofc. Temores are exposed he had access to his MAV recording, his taser recording and his taser activation data in addition to Ofc. Burger's MAV recording, Ofc. 1) Ofc. Manuel Temores' 1st Perjury Statement:
Temores stated under oath of penalty of perjury that he did not fire taser probes from his taser gun but hat he dropped his taser cartridge on the ground where it broke. However he did not nor did the PAPD command staff, specificall Sgt. Natasha Powers, Sgt. Mike Denson and Sgt. Mike Honiker and police chiefs Dennis Burns and Lynn Johnson did not take a picture of his broken taser cartridge and they did not retain it into evidence in violation of their own policy and state and federal laws.
Temores testified under penalty of perjury that he did not fire taser probes from his taser gun however Ofc. Burger confirmed with the medics at the scene that Temores did in fact fire taser probes from his taser gun.

Ofc. Temores testified that he collected his taser cartridge at the scene however he did not confirm that he turned it over to be secured into evidence.
Police Chief Dennis Burns would later testify in a discovery request that Temores' taser cartridge was destroyed in violation of department policy, state and federal laws without ever being photographed or documented in any manner. Dennis Burns statement that it was normal to destroy a broken taser cartridge is a lie and deception.
Three taser probes are seen at the incident. The one on the left and the one on the right were secured into evidence and photographed.
The taser probe in the middle in Ofc. Burger's hand was destroyed without ever being photographed or secured into evidence.

2) Ofc. Manuel Temores' 2nd Perjury Statement:
The fact is Ofc. Temores fired taser probes and discharged electricity at least 3 separate times verifies that Temores' taser gun activation data has been tampered with.

3) Ofc. Manuel Temores' 3rd Perjury Statement:
COfc. Manuel Temores testified that the battery that powers the microphone to his MAV recording system ran out of power which is why his MAV recording does not have any audio recorded to it. Santa Clara County Crime Lab analyst Christopher Corpora analyzed Temores' MAV recording and found that there was audio however it was (electronically) decreased to a low volume so that it could not be heard and that it did not match the audio from Burger's MAV recording. IF THE BATTERY RAN OUT OF POWER THERE WOULD NOT BE ANY AUDIO ON THE RECORDING. Temores is lying about there not being any audio and that the battery ran out of power, that's two false statements.
Temores testified that he checked that microphone batteries when going on duty that morning and they were charged. A fully charged battery will power the microphone for 10 continuous hours. There is no justifiable excuse as to why the batteries would run out of power prior to the incident.

4) Ofc. Manuel Temores' 4th Perjury Statement:
Temores stated under penalty of perjury that Ciampi got up off the ground however Ciampi is never seen getting up off the ground in Temores' MAV video even though Ofc. Temores' MAV recording ostensibly records everything.
Either Ofc. Temores made a false statement under penalty of perjury unnecessarily or he confirmed that his MAV recording has been tampered with and falsified.
Given that Temores viewed the original unadulterated MAV recording he not only knows that it has been tampered with and falsified but that he also gave false testimony regarding the altercation.

5) Ofc. Manuel Temores' MAV recording is missing the digitially stamped ID number signifying that it is an edited copy and not an untampered original.
6) Ofc. Manuel Temores' Taser Camera was sent to Taser International and destroyed in violation of department policy, state and federal laws. Taser International's Director of Technical Services Andrew Hinz who was hired by the PAPD to be their taser expert got caught making false statements to the federal court about the location of the taser cameras.

7) Ofc. Manuel Temores' MAV recording is supposed to have recorded everything however these frames video footage of the incident in question taken from the taser videos are missing from Temores' MAV recording verifyig that Temores' MAV recording has been edited, haveing content removed.
8) Ofc. Manuel Temores' MAV recording is supposed to match Ofc. Burger's MAV recording however the audio dialog of "Your Not Making it Easy" is missing from Burger's MAV recording verifying that both Burger's and Temores' MAV recordings are missing content, have had content removed.
9) Ofc. Manuel Temores taser video had frames of video not in chronological, (improperly indexed) order as verified by Santa Clara Crime Lab Analyst John Bourke.

- the suspect was violating a muni-code for sleeping in a car
- the suspect was watching a woman and child
- the suspect was under the influence of drugs

Below is irrefutable empirical evidence of Lt. April Wagner violating Title 18 U.S. Code § 1621 - Perjury.
Additionally Palo Alto Police Officer April Wagner asserted in her police report and Declarations that her bicycle helmet broke during the March 15, 2008 incident.
This is supported by photographs taken of her bicycle helmet at Stanford Hospital approximately an hour after the incident.
However Wagner's helmet was photographed undamaged 15 minutes after she claimed it had been damaged and 30 to 45 minutes prior to the photographs taken at the hospital. In this photograph the helmet is not damaged.
Conclusion: Wagner and her superior, Chief Dennis Burns, refused to secure her helmet into evidence because the helmet was not damaged. Wagner removed the visor from the helmet to falsely make it appear that it had been damaged when in fact it had not.
